Terms and Conditions

1. Definitions

1.1 These conditions apply to all agreements for the sale of Goods by Us to You, to the exclusion of all other terms and conditions which You may purport to apply under any purchase order or in correspondence elsewhere. “We”, “Us” and “Our” Cornish Lime Company Limited, Brims Park, Old Callywith Road, Bodmin PL31 2DZ, Company No. 4391187. “You” and “Your” The person seeking to purchase Goods from Us. “Goods” Any materials and products supplied by Us in accordance with these conditions. “Services” Any product processing or development, transportation of Goods, training, consultation, product testing or general advisory work undertaken by Us at Your request, either invoiced or provided free of charge. “Contract” The contract for the supply of Goods and Services incorporating these Terms.

2. Liability and warranty

2.1. We shall not be liable to You for any loss arising from or in connection with any representations made by Us or Our employees, except as they appear on the face of this document.

2.2. Where any valid claim is notified to Us, We reserve the right to replace the goods free of charge or, at Our sole discretion, refund You the price of the goods or a proportional part thereof, but We shall have no further liability to You.

2.3. Subject to the provisions of Clause 7 below, any claims for Goods alleged to be defective must be made in writing within 10 days of said defect becoming apparent.

2.4. When notification is so received, We reserve the right to request the return of said Goods or be granted a reasonable opportunity for us or our representative(s) to inspect the works or Goods in situ, and We cannot entertain any claim where any such request has been denied.

2.5. We shall not be liable if the Defect arises from wear and tear, wilful damage, negligence, abnormal working conditions, misuse, alteration or repair of the Goods, failure to follow British Standard or industry instructions relevant to the Goods, or storage of the Goods in unsuitable conditions.

2.6. We shall not be liable where any Defect would have been apparent on a reasonable inspection at the time of unloading, or where We notified You of any Defect or You identified any Defect prior to use but the Goods were used anyway.

2.7. We shall not be liable for any Defect that has arisen from any Goods manufactured, processed or acquired by Us to Your specification, where the Defect is found to have been as a result of the product formulation, Goods or materials specified by You.

2.8. Limitation of Liability All warranties, conditions and other terms implied by statute or common law (save for the conditions implied by section 12 of the Sale of Goods Act 1979) are, to the fullest extent of the law, excluded from any Contract of Sale. Our total liability in contract, tort (including negligence or breach of statutory duty) misrepresentation, restitution or otherwise, arising in connection with performance or contemplated performance of this Contract shall be limited to the contract price. We shall not be liable to You for any pure economic loss, loss of profit, loss of business, depletion of goodwill or otherwise, in each case whether direct, indirect or consequential, or any claims for consequential compensation whatsoever or howsoever caused, which arise out of or in connection with the Contract.

3. Terms of trade

3.1. Except where specific credit terms have been agreed, Goods will not be dispatched by Us until full payment has been received.

3.2. Where specific credit terms have been agreed, failure to pay in full by the agreed date can result in the immediate suspension of trade, and We reserve the right to suspend any pending orders and appropriate any payment to any goods or services as they determine, to charge statutory interest at a rate of 8% plus the Bank of England base rate on any balance outstanding, and to invoice You for any Goods or Services secured or manufactured or performed on Your behalf and hold said Goods until payment has been received in full.

3.3. You will remain liable for payment for all Goods delivered or Services performed on their behalf up to that time, whether invoiced or not.

4. Pricing

4.1. Unless otherwise stated all prices are exclusive of VAT, which shall be due at the rate ruling on the date of invoice. We reserve the right, by giving notice to You at any time before delivery, to increase the price of Goods and Services to reflect any increase in the cost to Us due to any factor beyond Our control (such as changes in transportation costs).

5. Title

5.1. Goods will remain in Our ownership until full payment has been received from You or Your agent(s), and are supplied on condition that You grant an irrevocable license to Us to enter any premises to remove Goods which have not been paid for within the agreed terms or where Your right to possession has terminated.

6. Order of cancellation & returns

6.1. Please notify us within 14 days of receiving Your goods if You would like to cancel or return the goods.

6.2. If Your order’s already in transit, we will no longer be able to cancel the order before it reaches You. As such, once the items are received, You can exchange or return Your items. Please notify Us within 14 days of receiving Your goods if You would like to cancel or return the goods.

6.3. Your items will need to be returned to us within 14 days of notifying us of Your intention to cancel or return.

6.4. Please complete the model cancellation form and contact the team using the information below to initiate a return or exchange. Please have Your sales receipt, order confirmation email, or order number at hand as proof of purchase.

6.5. Some returns may be subject to a 10% handling fee. Your return will be processed, or Your account will be credited within 14 days of receiving Your returned items. We do not accept returns from anyone other than the person who has bought the items.

6.6. Returns or exchanges of unopened and undamaged items in resalable condition are accepted within 14 days from the date of purchase in-store or the date of delivery with valid proof of purchase.

You cannot exchange, return or cancel orders for the following unless they are faulty

Perishable, made to order or made to measure items, which include:

Items that are made to measure or cut to size, such as mesh or hessian

Ready-mixed mortars, renders, plasters or grouts

Lime, cement or gypsum-based binders, including natural hydraulic lime, non-hydraulic lime, cement, gypsum or natural cement

White label, custom or bespoke made items, for example, a custom mortar, render or plaster or colour-matched or non-stocked paints

Items which become mixed inseparably with other items after delivery or collection

If You have any questions about any items You might be considering returning, speak with the team.

6.7. Returned items are your responsibility until they reach us, so please ensure You package Your items with care and get proof of postage in case You need to contact us about the return.

6.8. Items damaged due to insufficient packaging may reduce your refund as the item’s value has been reduced. Please be aware that You must cover the postage or delivery fees for any returns or goods for exchange.

7. Delivery terms & conditions

7.1 Safety and Access Requirements

7.1.2 The customer must ensure that the delivery site is safe and suitable for the delivery of heavy goods.

7.1.3 Adequate access must be provided for the delivery vehicles, including sufficient space for manoeuvring and unloading. It is advised that customers review our delivery vehicle dimensions can be found on our delivery information page. Read more about our delivery methods here at Cornish Lime.

7.1.4 The customer must inform Cornish Lime Company Limited of any specific considerations or potential hazards at the delivery site in advance.

7.2 Liability for Accidental Damage

7.2.1 Cornish Lime Company Limited will take all reasonable precautions to avoid causing accidental damage during delivery. However, the company shall not be held liable for any accidental damage to property or infrastructure that occurs due to inadequate or unsuitable access conditions.

7.2.2 The customer is responsible for ensuring that the delivery path is clear of obstructions and that any necessary precautions are taken to protect the delivery site in consideration of receiving a heavy goods vehicle. This is to include but not limited to, such things as manhole (drain) covers or underground services, surface finishes, paths or edgings. In requesting/expecting delivery vehicles off the public highway absolves Us of any liability for damage caused, within the realms of reasonable and safe practice.

7.3 Assumptions and Customer Responsibilities

7.3.1 Unless informed otherwise, Cornish Lime Company Limited will assume that the delivery site meets all necessary safety and access requirements.

7.3.2 The customer must provide clear instructions and inform Cornish Lime Company Limited of any specific considerations or requirements that should be taken into account during the delivery process, taking into account that we or our agents use HGV’s.

7.3.3 Failure to inform Cornish Lime Company Limited of any specific considerations or requirements may result in a postponed delivery, additional charges or non-delivery.

7.4. Delivery Process

7.4.1 The delivery team will conduct a basic visual assessment of the site upon arrival and prior to unloading. However, this in no way invalidates the customer’s responsibilities to inform our employee(s) of any issues that may not be apparent.

7.4.2 If the site is deemed unsafe or unsuitable, Cornish Lime Company Limited reserves the right to reschedule the delivery or impose additional charges for any necessary adjustments. In the event that an alternative delivery drop off point is agreed it becomes the responsibility of the customer and any return to site will be charged.

7.4.3 Excessive waiting time once onsite, or waiting for access will be subject to a discretionary charge.

7.5 Health and Safety Compliance

7.5.1 Cornish Lime Company Limited complies with all relevant health and safety regulations and expects customers or site managers to do the same.

7.5.2 Any breaches of health and safety regulations by the customer may result in the postponement or cancellation of the delivery, with any associated costs being the responsibility of the customer.

7.6 Delivery Procedures

7.6.1 Delivery charges will be clearly shown on the invoice.

7.6.2 Delivery Times are given in good faith, but are estimates only and shall not be of the essence of the Contract.

7.6.3 If You wish to instruct Us to deliver goods in Your absence, You must notify us in writing (email or letter) prior to the agreed delivery date. In this instance, You accept full responsibility for the goods once delivery has taken place, and in this instance, We cannot accept responsibility for delivery to the incorrect address.

7.6.4 Where a delivery is attempted and no-one is present to receive the order, nor can We contact You and the Goods are returned to the depot for re-delivery, a second delivery charge may apply. Any additional costs for re-delivery will be Your responsibility alone.

7.6.5 Ensure You inspect Your order upon delivery and before providing a signature. Please have the delivery driver wait while You inspect the items for accuracy, damage, and missing goods before signing any documentation.

7.6.6 Risk of damage to or loss of the goods will pass to You on receipt of the goods by You.

7.6.7 It is required that collections of goods are signed for with a legible signature and clearly printed name, by You or Your representative(s), who then accepts responsibility that the goods are received in good order.

7.6.8 If any item is damaged, please note any damage on the courier’s hand-held device or delivery paperwork, ensuring the order is signed as damaged on receipt and inform Us via email with a photograph within 48 hours of receipt. Damages must be fully reported within this time.

7.6.9 If a product You purchase is faulty, You may be offered a repair, exchange or refund as appropriate in accordance with Your consumer rights.

7.6.10 Any claim by You which is based on any alleged defect in the quality or condition of the goods or failure to correspond with the general specification shall be notified to Us no later than 48 hours from the time of delivery or receipt of the goods by You. If You do not notify Us accordingly, You shall be deemed to have accepted the goods and shall not be entitled to reject them.

8. Missing items

8.1. If any items are missing from an order, please notify us within three days of Your delivery.

9. Pallet deliveries & HGVs

9.1. Orders with pallets are delivered by Us or Third-Party Couriers on Heavy Goods Vehicles (HGVs), such as articulated lorries or similar vehicles.

9.2. For these deliveries, ensure that Your location can accommodate articulated lorries or similar vehicles.

9.3. If there are any concerns with access for delivery, please inform Us and any Third-Party Courier who contacts You regarding Your delivery.

9.4. Please ensure that Your drop-off point is level, stable and free of obstructions.

9.5. 3rd party Delivery will be made to the kerbside only, and private roads or tracks will not be accessed under any circumstances.

9.6. Drivers are not obligated to move or push pallets upon delivery.

9.7. If the area is considered unsuitable or unsafe for drop-off, the delivery may not be made.

9.8. In the event of a failed delivery, You may incur a redelivery fee.

10. Colour variance

10.1. All colours represented online or in printed materials are indicative.

10.2. Digital screens and printed materials may not accurately reflect the colour and finish of a product.

10.3. We advise purchasing a paint sample pot before making a final selection.

10.4. We accept no responsibility for any natural variations between batches of natural products, including sands, aggregates, mortars, renders or plasters.

10.5. Natural products may exhibit variations in colour, texture, and shape, so when consistency is crucial, we strongly advise each elevation is completed using material from the same batch to complete all works.

11. Technical, quotations & estimates

11.1. All material quantities used on site are dependent on worksite conditions and practices, and as such We do not stipulate quantities but only provide consumption guidelines.

11.2. You are responsible for ascertaining quantities required and the suitability of the Goods for their purpose. Any estimates of quantities, or advice on the suitability of any Goods for any particular purpose provided by Us is given without liability. By placing an order You acknowledge that You do not rely on any representations made by Us.

11.3. Quotations are valid for 30 days from submission.

12. Worksite safety

12.1. We recommend following safe workplace practices and observing all Hazard and Precautionary statements on Goods.

12.2. Always use the appropriate Personal Protective Equipment for the Goods provided. Further advice and information are available upon request.

13. Advice & information

13.1. The information provided by Cornish Lime in the Knowledgebase or other printed materials is for informational purposes only and does not amount to a specification.

13.2. Use of this information and reliance on any information on the website or other printed materials is solely at Your own risk.

13.3. Every project is unique, so please consult a professional before undertaking a project.

14. Course cancellations

14.1. Cornish Lime reserves the right to cancel courses for whatever reason before the date a course is due to commence.

14.2. Students of a cancelled course date may select another available course date or a full refund of all monies paid regarding fees for the course will be refunded.

14.3. Any financial losses suffered by a student as a result of the cancellation by Cornish Lime of a course shall be borne by the student. Cornish Lime accepts no liability for consequential losses.

15. Refunds for courses

15.1. Cancellations received within 14 days of booking a place on the course will receive a full refund.

15.2. Course returns will be processed, and we will refund Your order using the original payment method.

15.3. For cancellations received beyond the 14 days, refunds are allocated based on the time remaining until the course date, as this impacts our ability to refill the space.

Refunds are distributed as follows:

14 days+ days before the course: 100% refund

8 to 13 days before the course: 90% refund

7 days or less before the course: No refunds available

15.4. A minimum of 7 days’ notice is required to move to another course date.

15.5. Failure to complete the course shall not entitle You to withhold payment of fees or to receive a refund.

16. Refunds for services

16.1. If You want to cancel a service You have arranged online, over the phone, via email, or in-store, You can do so within 14 days.

16.2. If the service has begun during this 14-day period, we may keep a proportion of the agreed service fee to cover the costs of services provided up until the cancellation.
